Florida overtime formulas under FLSA
Because Florida has no separate state overtime statute beyond federal law, weekly pay follows these equations:
The overtime multiplier defaults to 1.5x, the federal minimum. Union contracts or employer policies may offer higher rates. No daily overtime in Florida
Unlike California, Alaska, or Nevada, Florida does not require premium pay when you work more than 8 hours in a single day. Only the weekly 40-hour threshold triggers overtime under state and federal rules applicable in Florida.
Example: an employee works four 10-hour days (40 hours total) and earns straight time for all hours. If they work a fifth 8-hour day, the first 40 hours remain at the regular rate and the additional 8 hours qualify for 1.5x overtime pay.

Who qualifies for overtime in Florida
